Department 36 – Financial Markets III
Department 36 operates in the field of consumer protection in financial services, including building savings. It formulates concepts, policies and strategies for overseeing compliance with conditions for provision of state support for building savings stipulated by Act No. 96/1993 Coll., on Building Savings Schemes and State Support for Building Savings Schemes, and exercises oversight over compliance with obligations set out in Act No. 42/1994 Coll., on State-Contributory Supplementary Pension Insurance and Act No. 427/2011 Coll., on Supplementary Pension Savings in connection with provision and returns of state contribution of supplementary pension insurance and supplementary pension savings, their approximation to international standards and coordination within the framework of the EU. It drafts methodologies for the performance of supervision and the related guidelines for enforcing fulfilment of obligations and administrative sanctions. It formulates concepts, determines the purpose, defines the assignment of and changes to information systems that are managed and operated by the Ministry for the purposes of supervision, processing of applications for state support for building savings and state contributions to supplementary pension insurance and supplementary pension savings and their returns and changes in the data on participants. It exercises the powers of the Ministry pursuant to Act No. 96/1993 Coll., Act No. 42/1994 Coll. and Act No. 427/2011 Coll. It ensures co-operation with public authorities and other persons within the scope of its competence. The department also develops concepts, policies and strategies for financial markets in the area of retail financial services, consumer protection in the financial market and financial education. Within the scope of its competence, it prepares strategic proposals, impact and comparative studies, proposals for substantive solutions, proposals for substantive intentions of laws and draft legal regulations, including regulatory impact assessments, and ensures their discussion in internal and external consultation proceedings, in the Ministry’s advisory bodies, in the Government Legislative Council and its committees, in the government and the Parliament and its committees. Within the scope of its competence, it represents the Czech Republic in working groups and committees of the European Commission and the Council of the EU and prepares documents for meetings of the Czech Republic's representative in the Council of the EU and its committees. Within the scope of its competence, it ensures compliance of legal regulations and their harmonization with the EU law and with other international obligations assumed by the Czech Republic. Within the scope of its competence, it ensures and processes additional agenda in relation to various EU bodies, the OECD and other international organizations, incl. representation of the Czech Republic in working groups and committees of the European Commission and the Council of the EU. It monitors and supports introduction of innovations in the financial markets.
