The department provides legal services in the field of international and European law and represents the interests of the Czech Republic before international judicial and arbitral tribunals. The Department resolves disputes arising from contracts for the promotion and protection of investments, cooperates with the Czech Republic’s legal representative, selected pursuant to Act No 137/2006 Coll., and assesses the notice of proceedings brought by a foreign entity against the Czech Republic in terms of the relevant contract for the promotion and protection of investments and evaluates the Czech Republic’s liabilities vis-à-vis international organisations in the area of the free movement of capital and international protection of investments. The Department carries out economic calculations and analyses relating to the course of litigation, provides the relevant accounting and consolidated data. The Department negotiates agreements for the promotion and protection of investments, is involved in negotiating agreements for the promotion and protection of investments negotiated within the EU and participates in negotiations on international investment issues and disputes within the framework of international organisations (OECD, WTO, UN - UNCTAD, UNCITRAL, UNIDROIT, ICSID etc.). The Department analyses the relevant case law of the EU Court of Justice that relates to the jurisdiction of the Ministry, proposes measures for the proper transposition of the acquis and is responsible for the adequate protection of its interests within the jurisdiction of the Ministry as concerns the EC and the ECJ. The Department ensures the operation of the SOLVIT system within the Ministry. The Department provides for and coordinates compliance with obligations relating to providing information to Parliament concerning draft EU instruments, provides systemic coordination of administrative and technical activities relating to the harmonisation of legal regulations within the Ministry and ensures monitoring and control of activities relating to the harmonisation of Czech law with EU law. The Department analyses the reform of EU law and prepares draft texts for basic contractual documents of the EU relating to the scope of competence of the Ministry. The Department maintains relations arising for the Ministry from its membership of the Council of Europe, participates in the preparation of legal documents concluded with foreign entities, including documents concluded within the framework of international organisations and institutions, with the exception of tax issues and the area of direct aid from the EU budget, and cooperates in the preparation of other legislation falling under the remit of other ministerial departments or other central government agencies, provides legal assistance in the field of international law to ministerial departments and ensures communication with the OPC in the area of approved state aid. In relation to the Ministerial organisation OGRPA, it carries out tasks as its national office, acts as an information centre for the Ministry and performs methodological activities and expert supervision within the meaning of Section 15 of Act No 201/2002 Coll., particularly with regard to the conduct of proceedings before foreign and international courts, arbitral bodies and other bodies (Section 3 paragraph 1 (c), Section 26 of Act No 201/2002 Coll..
