The department produces strategies for current and forthcoming international and domestic disputes arising from investment promotion and protection treaties and from the privatisation process, and arranges the coordination of disputes underway, including coordinating the administrative authorities concerned. It is concerned with the issue of the free movement of capital and services, in terms of the protection and promotion of investments on the basis of international treaties and as part of Czech legislation. It independently produces the conception for negotiation, and negotiates and interprets investment promotion and protection treaties. It resolves disputes arising from investment promotion and protection treaties. It interprets treaties on the settlement of property and finances concluded between the former Czechoslovak Socialist Republic and other countries. It contributes to the preparation of guarantee and credit agreements with foreign financial institutions. It cooperates on international law aspects of the preparation and concluding of contractual documents negotiated at the Ministry (with the exception of tax issues and the receipt of assistance from the EU budget). It is the coordinator for the protection of foreign investments at international forums. It analyses documents from the EU and other international organisations and incorporates the findings from those documents concerning the free movement of capital and services into amendments of the Foreign Exchange Act, and as required cooperates on the amendment and drafting of legislation for the purposes of harmonisation with EU law and the Czech Republic’s international commitments for the free movement of capital and services. In collaboration with the Ministry of Foreign Affairs it revises the decree stipulating the subsistence allowance for work travel abroad. It produces documentation for selection procedures in the field it covers. It covers the Czech Republic’s receivables and payables due from and to foreign governments. It undertakes the work stipulated for the Ministry in Act No. 215/2004 Coll., on the Regulation of Selected Relations in State Aid and on the amendment of the Act on Support for Research and Development. In collaboration with the Office for the Protection of Competition it assembles information at the Ministry as part of its obligations concerning notification and reporting to the European Commission, and in the Ministry’s role as the provider of state aid it coordinates measures to refund state aid that is incompatible with the common market. It implements the agenda associated with the administration of receivables and property interests, registered trademarks and legal disputes that devolved to the Ministry in connection with the termination of the work of the CCA. It is responsible for cooperation with the Financial Department for elaborating the financial statements and inventory for the CCA for 2007 and related work, including producing and filing the relevant tax returns.
